General Terms and Conditions (GTC)

§1 Scope

These General Terms and Conditions (hereinafter "GTC") of FrostedJewelz (hereinafter "Seller") apply to all contracts for the delivery of goods that a consumer or entrepreneur (hereinafter "Customer") concludes with the Seller with regard to the goods presented by the Seller in his online shop. The inclusion of the Customer's own conditions is hereby contradicted, unless otherwise agreed.

§2 Conclusion of contract

  1. The product presentations in the online shop serve to submit a binding purchase offer by the customer.
  2. The customer can submit the offer using the online order form integrated into the online shop. After placing the selected goods in the virtual shopping cart and completing the electronic ordering process, the customer submits a legally binding contract offer in relation to the goods contained in the shopping cart by clicking the button that completes the ordering process.
  3. The seller can accept the customer’s offer within five days,
    • by sending the customer a written order confirmation or an order confirmation in text form (fax or e-mail), whereby the receipt of the order confirmation by the customer is decisive, or
    • by delivering the ordered goods to the customer, whereby the receipt of the goods by the customer is decisive, or
    • by requesting payment from the customer after placing his order.

§3 Prices and payment conditions

  1. Unless otherwise stated in the seller's product description, the prices stated are total prices that include statutory sales tax. Any additional delivery and shipping costs are stated separately in the respective product description.
  2. The customer has various payment options available, which are specified in the seller’s online shop.
  3. If advance payment has been agreed, payment is due immediately after conclusion of the contract.

§4 Delivery and shipping conditions

  1. The delivery of goods takes place by shipping to the delivery address specified by the customer, unless otherwise agreed.
  2. If the transport company returns the shipped goods to the seller because delivery to the customer was not possible, the customer bears the costs for the unsuccessful shipment. This does not apply if the customer is not responsible for the circumstances that led to the impossibility of delivery or if he was temporarily prevented from accepting the service offered, unless the seller had announced the service to him a reasonable time in advance.

§5 Retention of title

The goods remain the property of the seller until the purchase price has been paid in full.

§6 Warranty

  1. The legal regulations apply.
  2. In the case of consumer contracts, the warranty period for used goods is one year from delivery of the goods to the customer. The shortening of the period does not apply to claims for damages by the customer due to injury to life, body or health or to material contractual obligations that must necessarily be fulfilled in order to achieve the purpose of the contract. This also does not apply to claims for damages following grossly negligent or intentional breach of duty by the seller or his vicarious agent.

§7 Final Provisions

Should individual provisions of this contract be or become invalid, the remainder of the contract shall remain valid.
